The Traffic Stop and Arrest

As experienced DUI attorneys, we know what elements of a DUI stop are legal and which are not. We will analyze your traffic stop from every angle to determine any and all DUI defense strategies:

• Reasonable suspicion — Did the police officer have reasonable suspicion to warrant a traffic stop? Failure to use a turn signal, speeding, weaving or driving outside of your lane are valid reasons to make a traffic stop. However, if police did not have a valid reason to pull you over, all evidence from the stop will be suppressed.
• Probable cause — Did the police officer have probable cause to administer a blood alcohol or Breathalyzer test? Admission of drinking, bloodshot or watery eyes, the odor of alcohol, fumbling of words or actions or instability while exiting the car are all actions that may warrant a blood alcohol or breath test. However, if your behavior was normal and did not suggest intoxication, the results of these tests may be deemed inadmissible.

Roadside sobriety checkpoints are not always legally sound. If you have been stopped at a sobriety checkpoint, our firm's attorneys can help to determine if the stop complied with Colorado law. Police are required to provide adequate warning of a checkpoint, and an opportunity for motorists to avoid it.
