Habitual Traffic Offender
Habitual Traffic Offender (HTO)
Anyone convicted of three major traffic offenses in three years can be deemed an Habitual Traffic Offender by the Colorado DMV. This means a five year revocation of their driver's license. These cases are treated very seriously by the DMV, courts, and prosecutors.
The first step is to determine if it is a valid revocation of your license to drive. The lawyers at Fuicelli & Lee, PC do that by examining your driving history and make sure there are enough violations within the seven year time frame to make you and Habitual Traffic Offender. Once we do this, we will sit down with you and see if there is any way to go back and fix any of the previous convictions.
If the Habitual Traffic Offender (HTO) designation is appropriate, it means a five year revocation of your driver's license. If an HTO is caught driving, it can mean up to 18 months of county jail and an extension of the revocation. However, the prosecution must prove not only that you are an Habitual Traffic Offender, but also that you KNOW you are an Habitual Traffic Offender. Being former prosecutors, attorneys John Lee and Keith Fuicelli know their way around a DMV record and can quickly assess whether the DA can prove his case against you. Contact us today so we can help you minimize these consequences.
Even more serious than that, an HTO who is also accused of DUI, or Driving Under the Influence can be charged with a felony. This means they could be sent to prison and have the revocation extended. The experienced attorneys at Fuicelli & Lee, PC can help you navigate through this maze of court proceedings. You need an experienced attorney by your side, making sure the DA can prove their case, and trying to get you the best possible outcome.
