Alcohol and Drug Usage

Truck Driver Substance Abuse Issues

Alcohol and drug use is one of the reasons automobile and truck accidents happen so often. Unfortunately, the problem is not limited to illegal drugs. People routinely use illegal or legally obtained prescription medications that can affect their ability to safely operate motor vehicles.

Colorado and Federal laws require that any time a commercial truck is involved in an accident that causes injury, a post-accident drug and alcohol test must be performed. The results of this test can be particularly incriminating to the trucking company and driver and can also lead to a claim for punitive damages.

The following is a list of commonly used intoxicating substances:

  • Alcohol
  • Marijuana
  • Cocaine
  • Amphetamines
  • Ecstasy
  • Heroin
  • Prescription medications, including painkillers like Vicodin and Percocet as well as muscle relaxants like Valium and Xanax

Five Truths The Jury Won't Hear At Trial

We list them here to provide a better basis to predict what a jury is likely to do with your case should it proceed to trial.

  • The Defendant HAS Insurance.
  • The defendant's lawyers are paid by the defendant's insurance company.
  • The defendant usually has no say over whether the case settles or not.
  • The defendant's "independent" doctors are anything but.
  • The plaintiff's health insurance company must be paid back.
